BAC's Terms and Conditions are aligned to the Electronic Communication and Transaction Act 2014 The terms and conditions ("Terms and Conditions") will cover your use of the BAC website located at the domain name ("the website"). By accessing and using the website and by making payment to BAC in accordance with the payment instructions provided on your invoice you agree to be bound by the Terms and Conditions

BAC reserves the rights to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this website. It is your responsibility to periodically check these Terms and Conditions and should you continue to use the website following the posting of changes or updates, your use will be considered notice of your acceptance to abide by and be bound to these Terms and Conditions including the changes/updates.

Limited Licence to General Users


BAC grants you, subject to the further terms of these Terms and Conditions, a non-exclusive, non-transferable, limited and revocable right to access, display, use, download and otherwise copy the current and future content of this website for personal, non-commercial and information purposes only. Any unauthorised use terminates this license. This website and its content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of BAC.

Privacy Policy


  • It is the policy of BAC not to share, distribute or sell our Clients' particulars to any 3rd Party. BAC will however use the Clients' details to inform and update the Client with any relevant information.
  • The BAC website uses the following Google Analytics features based on Display Advertising: Remarketing, Google Display Network Impression Reporting, the DoubleClick Campaign Manager integration or Google Analytics Demographics and Interest Reporting. Using the Ads Settings, visitors can opt out of Google Analytics for Display Advertising and customise Google Display Network ads. Please also refer to Google Analytics’ currently available opt outs for the web.
  • The BAC website makes use of remarketing to advertise online. Third-party vendors, including Google, may show our ads on sites across the Internet.
  • The BAC website and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimise and serve ads based on past visits to the BAC website.

Liability


  • The Client is personally responsible for all their belongings and equipment while at any of BAC's premises. BAC shall not be held responsible for any loss of or damage caused to any property belonging to the Client.
  • The Client shall have no claim against BAC and the Client hereby indemnifies and holds BAC free from liability in respect of any loss, damage or claims arising from death, injury or property damage sustained while on BAC premises.

Registration for Courses, Exams and Placing of an Order for Study Material or Institute Fees


  • If you wish to register for any of the courses facilitated by BAC and/or to order any study material, institute fees or distance learning product you must complete the relevant online registration form and make payment of the prescribed fee in accordance with our payment policy set out hereafter. Upon registration and/or placing your order you will be considered a Client of BAC and will at all times be subject to the Terms and Conditions set out herein.
  • BAC is a certified Pearson VUE Assessment Centre (in Gaborone), a licensed ACCA CBE centre (Gaborone) . Should the Client pay BAC for any exam or assessment fees, the Client is solely responsible for registering themselves with the relevant exam centre and institute.
  • The Client remains solely responsible to ensure that they are registered in time for the right subject at the right venue on the right date and that all assessment fees have been paid over to the institute.
  • Should the Client pay BAC for ICB registration or exam fees, it is the Client’s responsibility to register as a student and/or for the exam with the ICB via the ICB’s Student Portal and to provide BAC with the correct student reference number to enable BAC to pay over the registration or exam fee to the ICB. Students may be liable for any difference in fees due to an increase in institute and/or exam fees made by ICB.
  • All ICB institute fees are non-refundable, unless otherwise arranged with ICB directly.
  • Should the client pay BAC for ACCA CBE fees, it is the Client’s responsibility to register as a student and/or for the exam with the ACCA via their MyACCA account. BAC only accepts CBE fees for students writing computer-based ACCA exams at the licensed BAC ACCA exam centres in Gaborone. BAC does not accept any ACCA institute fees, or exam fees for written exams – the Client has to pay these fees over directly to the ACCA.
  • CIMA institute and exam fees are fixed in Pounds Sterling. These are payable in Botswana Pula at the administrative exchange rate of BAC and are subject to change without prior notice. These fees are paid directly to your MyCIMA account. Students may be liable for any difference in fees due to an increase in institute and/or exam fees made by CIMA. Please allow up to 10 working days for your CIMA fees to reflect in your MyCIMA account.
  • All CIMA institute fees are non-refundable, unless otherwise arranged with CIMA UK directly.
  • Should the Client pay BAC for CIMA registration, subscription, exemption, membership or examination fees, it is the Client’s responsibility to register as a student and/or for the specified examinations (CBA, OT or ICS) with CIMA and to provide BAC with the correct, active CIMA Contact ID number to enable BAC to pay over the fees to CIMA.
  • Should any CIMA fees be incorrectly allocated on a student’s MYCIMA account the Client needs to correspond with CIMA UK directly to rectify the matter. Queries should be sent to data.management@cimaglobal.com.
  • Should you wish to make any changes to your order post payment, you will need to request these changes in writing and email the request to onlinestudy@bac.ac.bw.

Online Course Contents and Access Terms


  • You may only purchase an Online Course if you are currently studying for an ACCA, CIMA, CFA or FIA qualification (as applicable) and are resident outside of the European Economic Area.
  • Please see the description of the Online Course available on www.bpp.com for details of the contents of the available Online Courses. Except as set out in the description of the Online Course, no additional Course Materials and/or tuition (either online, face to face or classroom) will be provided by BPP.
  • Your purchase of an Online Course does not include any accompanying hard copy study, but may include Online Study Materials.
  • You will be notified of when you will have access to the Online Course purchased and for the length of time such access will be made available to you, unless any such Online Course is removed.
  • The receipt of an Online Course is personal to you and you may not transfer your rights to access the Online Course or provide an Online Course to any other person. You may not share your Online Course or your log-in details with any other person.
  • You may incur charges to your internet service provider while you are accessing and/or downloading the Course Materials. Charges may also be payable to third parties for use of the software necessary to access and/or download the Course Materials. You are responsible for paying these charges.
  • You acknowledge that BAC and BPP operate a zero tolerance policy in relation to inappropriate behaviour of End Users. In particular abusive or violent behaviour directed at BAC or BPP’s staff or other End Users and unfair or dishonest practices (including but not limited to cheating), will not be tolerated under any circumstances. BAC and BPP may at their reasonable discretion and without liability or an obligation to refund course fees, refuse to supply any Online Course to any End User in the circumstances where you have participated in inappropriate behaviour as aforesaid.
  • BPP reserves the right, at BPP’s sole discretion, to suspend the provision to you of the relevant Online Course if you are in breach of these terms or if BPP has not received payment of your course fee from BAC.

System Requirements


Please note that it is your responsibility to check that the computer you plan to use to access your Course Materials and the Online Course (and MyStudy, where applicable) is compatible with the minimum specification requirement that relates to the Online Course you are ordering. The current minimum specification requirements for the Online Courses are:

  • While certain operating systems and browsers are not officially supported it is probable that you will be able to use them to view content. BAC and BPP will try to help where we can but cannot guarantee we will be able to resolve the issue if you use one of the unsupported operating systems or browsers.
  • You acknowledge and accept that neither BAC nor BPP can be held responsible for any technical problems you encounter following the purchase of an Online Course.

Modifications to content of existing courses or technology enhancements


From time to time, modifications, enhancements or issue clarifications (for example, to clarify ambiguous regulatory drafting) may be made to the audio-visual, interactive or written Online Courses. You will have access to such changes free of charge only to the extent that such changes relate to the Online Course purchased by you.

Annual (or other term) Updates


Certain Online Courses will periodically be superseded by new legislation or the issue of new regulations. If new legislation or regulations supersedes existing Online Courses, these may be available for purchase as new Online Courses. For the avoidance of doubt, purchase of a current Online Course does not entitle you to have access to future revised Online Courses as part of the original purchase.

Technical Support and Access


  • BAC and BPP will provide technical and content support to individuals who have purchased an Online Course in respect of the Online Course purchased (and MyStudy, where applicable), in accordance with the provisions referred to below.
  • If you report a fault to BAC or BPP, BAC or BPP will use reasonable endeavours to provide a solution but neither BAC nor BPP guarantees that the technical support provided will resolve your technical problems. If you receive technical advice from BAC or BPP then neither BAC nor BPP will accept any responsibility for any problem if you do not ensure that such advice is strictly followed.
  • You accept and acknowledge that periods of downtime may be required in respect of the information technology infrastructure connected to the relevant Online Course website and that technical support may not be available during such periods of downtime. Further you accept that you will not have a claim for breach of contract or otherwise in respect of such period of unavailability.
  • BAC and BPP will use reasonable endeavours to make the Online Course (and MyStudy, where applicable) available but cannot guarantee uninterrupted, timely or error free availability or that defects will be corrected. BPP reserves the right to suspend access to the Website for the purpose of scheduled or emergency maintenance, repairs or upgrades to improve the performance or functionality of the Website.
  • You also accept and acknowledge that neither BAC nor BPP can be held responsible for any delay or disruptions to your access to the Online Course (and MyStudy, where applicable) as a result of such suspension or any of the following: 1. the operation of the internet and the World Wide Web, including but not limited to viruses;
    2. any firewall restrictions that have been placed on your network or the computer you are using to access the Online Course (or MyStudy, where applicable);
    3. failures of telecommunications links and equipment; or
    4. updated browser issues.

Warranties


  • You will be provided with the Course Materials in accordance with the Online Course description available at www.bpp.com.
  • You are expected to take reasonable care to verify that the Online Course and Course Materials in question will meet your needs. Neither BAC nor BPP make any commitment to you that you will obtain any particular result from your use of the Course Materials or that you will obtain any particular qualification on completion of the Online Course (unless otherwise stated).
  • Neither BAC nor BPP make any representation, guarantee or commitment to you that the Course Materials will be error free.
  • Neither BAC nor BPP make any commitment that any Online Study Materials (and MyStudy, where applicable) will be compatible with or operate with your software or hardware.
  • All representations, warranties and/or terms and/or commitments not expressly set out in these terms (whether implied by law, conduct, statute or otherwise) are hereby excluded to the maximum extent permissible at law.

Limitation of Liability


  • The exclusions and limitations of liability contained in these terms do not apply to a party’s liability:
    1. for fraud or wilful default;
    2. for death or personal injury caused by its negligence; or
    3. where such limitation or exclusion cannot lawfully be excluded.
  • To the fullest extent permitted in law, except as set out in these terms, neither BAC nor BPP shall be responsible for losses that result from their failure to comply with these terms including, but not limited to, losses that fall into the following categories:
    1. indirect or consequential losses;
    2. loss of income or revenue;
    3. loss of business;
    4. loss of anticipated savings; or
    5. loss or corruption of data.
  • To the fullest extent permitted in law, neither BAC nor BPP are responsible to you for any data that you lose either (a) as a result of accessing the Online Study Materials or MyStudy; or (b) during completion of any Online Course via the website. It is your responsibility to ensure that you regularly save and back up (i) all data which you hold on the computer from which you are accessing the Online Study Materials and MyStudy, and (ii) all data that you are inputting when completing the Online Course.
  • Save as otherwise set out in this section “Limitation of liability”, BAC and BPP’s maximum aggregate liability to you for any claims that you may have against BAC or BPP for direct loss in contract, tort or otherwise arising out of or in connection with these terms, the Online Course, your use of the Course Materials and any technical support shall be limited to the amount of the course fee which has been paid, or is payable, by you or on your behalf.
  • Neither BAC nor BPP will be held responsible for any delay or failure to comply with their obligations under these terms if the delay or failure arises from any cause which is beyond BAC or BPP’s reasonable control. This condition does not affect your statutory rights.
  • Each provision in this Clause 7 shall be construed separately. If any part is held to be unreasonable, inapplicable, or unenforceable, but would be valid if some part thereof was deleted such provision shall apply but with such modification as may be necessary to make it valid and effective.

Disclaimer


The Online Courses are for training purposes only. Neither BAC nor BPP will accept any responsibility to any party for the use of the Course Materials for any purpose other than training for educational purposes, including but not limited to the giving of advice by you to any third party.

Intellectual Property


  • At all times, BPP and/or its licensors, remain the owner of the intellectual property in the Online Courses, the Course Materials and MyStudy content. No Online Course and/or Course Materials and/or MyStudy content, nor any part of it may be reproduced, stored in a retrieval system or transmitted any form or by any means without the prior written permission of BPP.
  • BPP grants to you a non-exclusive, non-transferable licence to use the Course Materials and MyStudy content for the sole purpose of studying for the Online Course. For Online Study Materials the licence granted is to use the Online Study Materials on one computer only.
  • Save as expressly set out in these Terms, you may not modify, copy, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit, make available, disseminate or distribute in any way any of the Course Materials or MyStudy content. You may not modify, adapt, merge, translate, disassemble, decompile, recompile or reverse engineer any software forming part of the Online Study Materials or MyStudy or create derivative works based on the whole of or any part, or which incorporate, the Online Study Materials or MyStudy into any software program. Use of the Course Materials not expressly permitted in these terms is strictly prohibited and will constitute an infringement of either BPP’s copyright or BPP’s other intellectual property rights, and / or the copyright or other intellectual property rights of BPP’s licensors.

Data Protection


  • BAC will process the information it receives from you or otherwise holds about you in accordance with these Terms and its privacy policy. You consent to the use by BAC of such information in accordance with these Terms and BAC’s privacy policy.
  • BPP will process the information it receives from you or otherwise holds about you in accordance with its privacy policy. You consent to the use by BPP of such information in accordance with the BPP privacy policy. You have the right to receive details of the personal information held by BPP. A fee of £10 will be payable. For more information, please refer to BPP’s privacy policy.
  • BAC and/or BPP may report any cases of fraud or attempted fraud, academic misconduct or unethical behaviour to the relevant external awarding bodies and professional bodies.
  • You agree to BPP controlling and processing your personal data (including sensitive personal data) in accordance with BPP’s Privacy Policy (as amended from time to time). In particular, BPP may use your personal data (including sensitive personal data) and share your personal data with International Business Training College (BAC) including but not limited to your examination results (both mock and actual) relating to any course of study.
  • In terms of this clause, “BPP” means any company within the BPP Professional Education Group and which includes (but is not limited to) BPP Professional Education Limited, BPP University College of Professional Studies Limited and BPP Learning Media Limited.
  • BPP’s Privacy Policy is available at www.bpp.com/privacy and may be amended by BPP from time to time.
